DELHI- The United States maintains its Visa Waiver Program (VWP), offering citizens from 41 designated countries visa-free entry for tourism or business visits lasting up to 90 days. India remains outside the program despite covering numerous European and Asia-Pacific nations.

This initiative strengthens diplomatic relationships while streamlining international travel processes. The program requires travellers to obtain Electronic System for Travel Authorisation (ESTA) approval rather than traditional visas.

US Visa Waiver Program (VWP)

The U.S. Department of Homeland Security administers the Visa Waiver Program (VWP) in collaboration with the Department of State. The initiative creates simplified entry procedures while maintaining stringent security protocols for short-term travel between the United States and partner nations.

Citizens from approved countries avoid visa application requirements for visits not exceeding 90 days when travelling for tourism or business purposes.

The program operates on reciprocity principles, with American citizens receiving similar entry privileges when visiting participating nations for comparable durations.

VWP Nations as of April 2025

The roster of 41 countries currently participating in the Visa Waiver Program (VWP) spans multiple continents and regions:

European nations dominate the list- The United Kingdom, Austria, Belgium, Croatia, Czech Republic, Denmark, Estonia, Finland, France, Germany, Greece, Hungary, Iceland, Ireland, Italy, Latvia, Liechtenstein, Lithuania, Luxembourg, Malta, Monaco, Netherlands, Norway, Poland, Portugal, San Marino, Slovakia, Slovenia, Spain, Sweden, and Switzerland.

The Asia-Pacific region comprises 7 members- Australia, Japan, New Zealand, the Republic of Korea, Singapore, Taiwan, and Brunei.

Middle Eastern participation includes Israel and Qatar, while other participating nations include Andorra and Chile.

India’s Status

India remains excluded from the Visa Waiver Program (VWP), requiring Indian citizens to pursue traditional visa application processes.

Indian travellers must apply for B1 (business) or B2 (tourist) visas through U.S. consulates or embassies. Multiple factors likely contribute to India’s exclusion, including reciprocity requirements, immigration patterns, security considerations, and bilateral policy evaluations.

Eligibility Criteria

While the program provides visa-free travel opportunities, not all citizens from participating countries automatically qualify. Eligibility requirements include:

Possession of a passport issued by a VWP member country. Travel purpose is limited to business activities or tourism. Planned stays not exceeding 90 days. Successful ESTA application and approval before boarding U.S.-bound flights.

Restrictions

Certain conditions disqualify travellers even when holding passports from VWP countries. Recent travel history to Iran, North Korea, or Cuba (on or after January 12, 2021) may render individuals ineligible for the program.

Dual citizenship also affects eligibility, as citizens holding dual nationality with countries such as Iran, Iraq, Syria, Sudan, Cuba, or North Korea cannot participate in the VWP. These individuals must instead pursue B1 or B2 visas through standard application channels.

Conventional Visa Options

For travellers from non-participating countries like India or those disqualified from the VWP, B-1 and B-2 visas provide the standard pathway for short-term U.S. visits.

The B1 visa serves business purposes, covering activities like conference attendance, business associate consultations, or contract negotiations. The B2 visa facilitates tourism, medical treatment access, or family visits. Many applicants receive the combination B1/B2 visa, allowing both business and leisure activities during a single trip. Importantly, neither visa permits employment within the United States.

ESTA Application Process

Before travelling under the VWP, eligible individuals must secure Electronic System for Travel Authorisation (ESTA) approval. This pre-screening system evaluates eligibility before boarding U.S.-bound transportation.

ESTA functions as a travel authorisation rather than a visa substitute and remains valid for two years or until passport expiration. Approved travellers may make multiple U.S. trips provided each stay remains under 90 days. Applications should be submitted at least 72 hours before departure, though earlier application is recommended.

The application process requires visiting the official ESTA website, completing online forms with personal and travel information, answering security-related eligibility questions, paying processing fees, and awaiting confirmation, typically delivered via email.

Final entry decisions remain at the discretion of U.S. Customs and Border Protection officers conducting inspections upon arrival, regardless of ESTA status.

Security Protocols

The Visa Waiver Program (VWP) has incorporated enhanced security measures, particularly following the 2015 modifications. The system cross-references traveller data against various databases to identify security threats, criminal backgrounds, and previous immigration violations.

The U.S. Congress and the Department of Homeland Security continuously review eligibility standards and participating countries. Nations may join or exit the program based on evolving geopolitical circumstances and security considerations.
